2012 Baseball Captain - Ian McClendon

For my Capstone project I am writing about being SLA’s Baseball Captain for the 3rd year. I played on the team for the year before and this year of, sadly, my senior year. The reason why I wanted to focus my capstone on Baseball was because I felt that I had/ still have a strong relation with the team and vise versa. It is sad that this is the last year I can play as a kid in high school but that won’t stop me from coming back next year to assistant coach.

Ian McClendon - 5 Point Frame Work Ecuador + Brazil

Between the two countries of Ecuador and Brazil I happen to see more similarities than differences in my analysis of the 5-Point Frame Work. Both countries or bordered to each other and contain some of the same agriculture, societies, and environmental issues. Upon analysis for example; say that Ecuador has major problems with pollution and dangerous predicted climate change Brazil has issues with their natural wildlife and deforestation leading to more pollution and climate problems. Since they both boarder each other they seem to have similar problems but in certain sections Brazil is worse than Ecuador for Environmental Damage while Ecuador is at a increased risk for dangerous climate elements such as, volcanos and earthquakes. The one thing I would want to change in my project would be how I interpret the 5-Point Frame Work between the two countries. I felt that I was only limited to analyzing what a semi-higher up 3rd world country would be like. I'd especially remove Society's Response to Environmental Damage because its all being wrecked and only 1st world countries are willing to save it. Honestly this project got me thinking about other countries and how similar they are to Easter Island but bigger.

World of 100 Analysis

​For a class of at least 32-34 students we had to deiced what the rest of the world would be like if there were only 100 people. The sheet of paper that we had to give our estimations on included a lot of possibilities and diverse features of civilization. So each student wrote down their estimation of how the World of 100 would stack up. After words when the whole class put down their responses they were totaled and averaged. To sum all of it we referred to actual data that represented the World if only 100 people lived. Next was to compare everything from My Average, Class Average, and the Correct Averages. On the paper there were 12 topics from the ratios of Gender, Education, to Religion. I picked 3 of the topics that was most interesting to me even before we looked at the class average or the correct average. So I choose Geography, Age, and Electricity. (results displayed below)

Q2 Apple Satire - Ian McClendon

As we see in society everyone owns a iPhone, iPad, or any other Apple product and it seems to symbolize/ portray the sense of the Apple Inc. being a independent and creative company. The use of their technology, don’t get me wrong, is very customizable and can be controlled with ease but would it occur to the typical user that Apple created their own software, interfaces, or processing modules that makes their iPhone so unique? The answer is no/ not quite. The way I would describe Apple Inc. in the global market is being a Patent Troll to all. 

So what I’ve tried to create here is a Apple Satire of the iPhone and how unoriginal I see as being. In my poster I point out specific applications and programs and then expose how the Patent Troll Apple is not who they seem to be. Also what such a profit they make from someones creation. In each box deriving from the application I show the inventor, description of patent, and the price that Apple bought.

With my group Blase, Kern, and I we chose Protecting Civil Liberties in Schools because in our school particularly surrounded by technology this is an important issue. So we set out to get the thoughts of our classmates to understand the views of their own privacy. I enjoyed creating this project because since the issue is about unrestricted searches through their phones, devices, and even computers. So forth these liberties put upon students growing up with new technology are unaware of how much privacy they actually have. The most challenging was how to separate our essential questions about the privacy in and out of school. Also since we weren't sure of how much power the school district had in conducting a case. Another aspect that we could improve was to get more information about actual cases of students privacy being violated and whom in command pursues the information in a case.

SCOTUS Case: Martel vs. Clair - Ian McClendon

Review of Case: This Supreme Court Case Michael Martel vs. Kenneth Clair is presented the question of whether a condemned prisoner of capital federal habeas corpus can change his court appointed counsel because he was dissatisfied with his first counsels investigations. But the replacement for a new counsel if protected by habeas corpus should expresses dissatisfactory but also should be in the "interest of justice." 

Facts of the Case: In Kenneth Clairs defense being under protection of a federal habeas corpus for 10 years should not influence the decision to be able to be appointed a new court counsel since Kenneth was dissatisfied with his previous counsel. During the state court case the judge expressed that the counsel was doing a proper job for his client but it was not said that Clair was entitled to a new counsel. Clair filed for a petition of his federal habeas corpus and for a new counsel. The judge denied his request and then the day after he retired. Right after Clair talked to his counsel and came to a legit conclusion that the "attorney-client relationship had broken" and a appeal for a new counsel would be appropriate. So with the approval of a new counsel, Clair tried for a habeas corpus petition and the substitution for the new counsel before the district court was even ready for ruling.  

In Michael Martel argument he expresses that after the decision made by the Ninth District Court Clair was distort about the verdict and shortly after he explained that he wasn't content with his counsel and wanted a new counsel. The districts court response was that "no conflict of interest or inadequacy of counsel is shown". So therefor they denied the petition for release of federal habeas corpus. Clair appealed and was appointed a new lawyer to revise his statement to expressing "dissatisfaction" which calls for no further dispute of getting a new counsel for that would be unconstitutional. The Amendment that is controversial is the 6th which states, "In all criminal prosecutions, ... and to have the assistance of counsel for his defense." 

Summary of Arguments Before Case: When Clair was appointed his new counsel he also independently hired a private investigator in August 2005, C.J. Ford, whom took over the case. In March 2005, Clair sent a letter to the District Court saying that he did not want to be represented by a Federal Public Defender, stating that his old counsel, "displayed a degree of messiness." Also that the counsel was trying to save his life rather than trying to prove his innocence and get him out of prison. The State's retaliation to the letter was Clair had "shown no cause to dismiss counsel"and that "Clair had meet with the Federal Public Defender and he agreed that the counsel should continue to represent him but still have the right to take action later. To clarify Clair's argument he summed it all up in a second letter. He asked for his counsel to be renewed and an addition of a complaint. During C.J. Ford's inspection recovered new evidence from the original crime scene and was unable to locate a witness which both of which Clair complains his normal counsel did not look hard enough for. But the key factor here is that back in 1984 at the time of the Linda Rogers murder the detectives didn't have nearly enough technology that would've helped find crucial evidence for the case in favor of Kenneth Clair. When the Petitioner and counsel asked to review the recovered evidence the police department claimed that the evidence was lost or destroyed but in May 2005 Ford dug deeper into the problem and recovered the evidence. With further analysis it was determined that no biological evidence of Kenneth Clair was found at the scene of the crime. Although was sparked more controversy was that much of this investigation was done independently and not mentioned to the district court, counsel, or lawyer. A few months later the case was retired of habeas corpus and reassigned with repeating claims of being dissatisfied with his old counsel and that the evidence should be used in trial supporting Clair. Many stipulations occur again and again with appeals and request of relief of habeas corpus and improper use of collecting evidence. 

Outcome of Case: From listening and reading the transcript I believe that the Court would favor for Clair. Because at the beginning of the issue the Federal Public Defense did not conduct their litigations properly to justify Clair in the first place. The denial of Clairs appointment to new counsel was unconstitutional and there shouldn't have been such friction of Clairs request but for his innocence of connecting him to the murder of Linda Rogers. In the end the degree of messiness overturned the case in favor of Clair.

Tim and I decided to create a chart process of Enlisting for Active Army Duty. Of course this is a time consuming process which takes devotion and dedication is you are serious about joining the Army. There are many meetings to go to and test's to take to prove yourself but in the end it's when you are suited up and looking in the mirror as an United States Army Recruit. From my research there are many requirements and qualifications for serving but the M.E.P.S is the organization that can curve the paperwork to suit your needs of contributing in the Army

SCOTUS Case: Hall vs. United States - Ian McClendon

SCOTUS Blog Case: Hall vs. United States 

For the case description plain english whether capital gain taxes created by the sale of the family farm during a Chapter 12 bankruptcy proceeding are payable as an administrative expense under the bankruptcy reorganization plan?

Facts of the case Lynwood and Brenda Hall had to file for Chapter 12 Bankruptcy and in due had to pay $980,000 in bankruptcy debt. Hall was forced to sell their family farm to pay for the debt. But what Hall didn't see coming is that there was also a capital gains tax of $26,000. Hall wanted the taxes to be payed as a part of the bankruptcy. Much of the IRS disowns these request because the accumulated gain taxes were presented in 2005. But what is stated in Chapter 12 is that when filed the debt towards the debtor or the debtors property "automatically stays". But which is also stated under the 11 U.S.C. § 362(B) does not operate as a sort of tax refund to the debtor. That was from just researching the Bankruptcy Filing Chapter which I just found out that is irrelevant.  

Before the Argument written by Ronald Mann, he describes this case as being a classic puzzle. Also he explains that they were lucky to find a purchaser that would be willing to pay well above for the debt against it. With some over view there might be some good beginning statements for her case but the process for completing the Chapter 12 Bankruptcy was done incorrectly.  

My Prediction of the Outcome I believe that this case does bring up many constitutional and congressional questions to how this case should be handled but it shows more in favor of the United States for Hall to pay for the $26,000 gains tax. Being in debt since 2005 and then filing for bankruptcy should cover when the trustee is not controlled by the estate and when the estate does not cover administrative fees the taxes should be payed. Also as said, they were lucky to find a purchaser to pay with already larger amount of applied debts.

Ian McClendon - Lobbying Blog #3

The Triangles on Grays Ferry Gateway Project has been on a hiatus since its last Community Meeting on March 29th. Some major names were present at such as Terri Paone from the Presidents Anna Verna City Council Office. Also State Representative Babette Josephs was there in the break out groups.

Babette Josephs, State Representative, lives near by Grays Ferry and in the meeting she stated that she "has been watching this effort very closely, that the future of this area will be decided by the neighbors, and that what ever decisions are made she will be there to help out!" As the State Representative of the 182nd District she controls a office in Grays Ferry, a District office on Walnut St., and another House of Representatives office in Harrisburg. Honestly who knows how much assistance can she be for the rapid recreation of Grays Ferry?

As for Terri Paone, I wasn't able to find much background about her. Terri is a member of the (PHCD) Philadelphia Housing Development Corporation Board of Directors. Her presence at the citizen group meeting doesn't seem to useful in pushing forward for the actual changes of Grays Ferry but although Paone could contribute good ideas for the structure and design of improving the area.

With the help of all these local organizations the community was able to have hired 2 traffic engineers from the Philadelphia Streets Department to review the map, traffic flow, and local business import and exporting areas. At the meeting that I attended last year the engineers where there for the first time and presented many different blue prints of re-mapping the area.

This is just that time where not much, or any at all, action is being taken for the Gateway Project. Now, Im not saying that the citizens, organizations, and the whole community is just lying on their back and giving up but that this is not the right time to focus on a single area of Philadelphia when America is struggling itself. I believe that in a couple years when the economy is back on track Grays Ferry would be first in line to receive notice from City Hall accepting much needed recreation.

A Healthy Meal of Home Style Chicken Soup - Ian McClendon

My Home Style Chicken Soup Recipe and Analysis:

For my Home Style Chicken Soup the ingredients were: 

6 cups of chicken broth

1 1/2 pounds of boneless, skinless chicken breast, cubed

1 cup sliced mushrooms

1 red bell pepper, chopped

1 onion, chopped

3 teaspoons minced garlic

2 tablespoons grated fresh ginger 

1/2 teaspoon crushed red pepper

Added salt and black pepper

Analysis:

-The meal that I made was more whole food than processed foods. Only the broth ingredient was brand name and the other was the packaged chicken breast which is pretty processed. 

-Over all the meal itself was not that high in calories. From eating my Home Style Soup I felt nutritiously filled and satisfied by the aroma of flavors and if I had to eat nothing but this soup I could stand it for about a week but other than that the ingredients would not have a substantial impact on your body because it's filled with proteins and organic vegetables. 

-Where my ingredients came from I have no clue but from a super market. My mother was nice enough to pick them up herself. I believe that there are no environmental issues with the meal. 

- Fast food versus the soup can not compare, the preparation time took 15 minutes, served up to 10-12 people when given in smaller portions, and the cooking time in a Crock-Pot was 3.5 hours. I believe that every corporation benefited from the purchase of my ingredients. 

My Personal Reflection of this meal: 

During this whole quarter I probably learned more than I ever wanted to know about food. Watching the Food Inc. movie made me realize a lot more about what's out there in middle America. All of the enormous fields of grass that you see as you're flying in a airplane are the hidden facts of how our food is made. From what I've learned I don't see myself as having a huge role in large food business but my parent usually purchases the groceries. About once a month I would go grocery shopping with her and specifically pick brands. I noticed that my mother is more of a savvy shopper than I am. She buys the discounted healthier foods and I search for the junk food. The biggest problem that America faces is blocked by the satisfying feeling of the food itself. The production of all our sugars, spices, and everything nice is not regulated by the consumers but by the corporations who's idea in mind is money, money, money. GMO's control our source of "nutrition" and "energy" for the food. But still I feel that all this won't drastically change my perspective on my consumption of healthy and junky food. Although I do feel that I have limited myself to eating junk food and healthy food. Of course like anything that I've learned in SLA has been very informative and useful to my own prior knowledge.

History of DOMA - Ian McClendon

  • Explain your decision making for choosing the bill.
    -I chose the DOMA bill because I knew that there was always a lot of controversy involving this law. A mass population is effected by what they can and can't do to show love for their partner. I also wanted to see what major names put the bill into law and their perspectives on it then and now.   

  • Why did you choose the particular presentation format?
    -I picked a video format because Keynote Slide Shows and certain forms of presentation were already made. So I wanted to try a sort of News/ Documentary video. Instead of keeping it boring with 5 minutes of me talking in one video, I tried to change the frames for each sentence to keep the viewers attention while I move around the screen and keeping a verbal flow. 

     
  • What challenges did you overcome in completing the project?
    -Other than other people doing the same bill as me the only challenge was to make something different than the others. 

  • How would you do the project differently if you had to do it over again?
    -I would have a different set up for my scenes, different location, better camera/ audio, and to become more fluent with my speech. 

  • What did the research and investigation tell you about the creation process... from idea to bill to law?
    -As I researched I couldn't find legit websites for DOMA but I slightly referenced Wikipedia and their resources for finding my information. There was not much clarification about this act but I managed to complete the essential details for the history of the bill.  

  • Was the process easier or harder than you imagined based on your particular bill/law research?
    -It was a little challenging at first but I came up with the idea of how I was gonna present this. Then it flowed together into my final production of The History of DOMA.

Why I Write - Ian McClendon

​ I could count the many ways why I write. I write to my friends, teachers, peers, family members, through text messaging, email, letters, tiny notes to pass across the class room. Other reason why I write is to express myself in the confinement of a two page paper about me. Or a sporadic impulse of rhythmic words travel through my mind into my hand wielding a ball point pen. Most of the time it all comes to a halt. Sometimes I'm not even able to conjure a sentence that doesn't sound odd or out of place… Slowly but surely the gears begging to move. To ask why I write is like a three step cycle for me. I contemplate, indorse, and produce. But like I said this giant boulder does not give way with the stroke of a pen, pencil, or even blood if I tried.

The Triangles on Greys Ferry Gateway Project: District Representatives


The process of this Gateway Project has gotten attention in the past and also made slight progress in advancing Greys Ferry. A earlier meeting conducted on March 29th with two State Representatives Babette Josephs and Terri Paone. Both from the Council President’s Anna Verna’s office.

The area that concerns my lobbying topic is of the 2nd District run by the Council President Anna Verna. She has been in office for 9 terms. Verna was seen as a main asset to fixing Philadelphia’s financial problem. In her Anna Verna’s description on the City Councils website she seems to be more in house renovations, financial debts, and business taxes. Not so much for city street reconstruction. Then again Verna’s district consist of all of Center City, South and Southwest Philadelphia. And not to mention, again, that she is the President of City Council. There must be a lot on her to do list for her to tend to three triangles on Greys Ferry.

Of the two State Representatives, Babette Josephs was the more distinguished government official than Terri Paone. As I was browsing her site Babette looks like more of a people person.

The Triangles on Grays Ferry Avenue Gateway Project


Last year for my American History class an assignment we had was to attend or assist a community meeting. I chose The Triangles on Grays Ferry Avenue Community to help. It was a very well organized group of citizens that came together to get the current and past residents ideas pertaining to businesses, traffic, safety, place identity, and green economic development for new structures of Grays Ferry.  

I lobby for this Community Project because as a neighborhood that is the start of a major avenue branching from the popular South street. Those areas(G.F. Triangles) should not be subject to speeding motorist disregarding traffic signs, J-walking pedestrians because of improper crosswalk placement, and limited vehicle space for businesses to load and unload product. At first I didn’t think that a meeting to improve someones community would be beneficial for me until these Break-Out groups were formed to initiate discussing every problem there is to know about it. Then you realize how much this area could be improved and be more of a convenience by living in Philly.

This committees foundation started with concerned neighbors and was progressively sponsored by many local associations such as SOSNA, CCRA, SOSCDC, and SSWBA. Besides all thel associations, what really makes collaborating click is the people at the meetings. Elder resident, business owners, previous/ current house owners, residents living outside the triangles, and guests of Traffic Planning and Design, Inc to contribute multiple solutions for the new design of Grays Ferry. The meeting I attended was Greater St. Matthews Baptist Church on the corner of a triangle. Everyday of Mass the main issue for the Church is parking spaces so the idea for change is in everyone mind for the surrounding organizations.


In my research for more information about how Grays Ferry was originated I came across a Congressional Meeting with the transcript of when the development of the area was still underway. It explains the statistics and proposed formulas to how the traffic flow and train yard transit can move easily together. This congressional text was made on April 11, 1914 by Mr. La Pollette and Mr. Fletcher and called it the “FIVE PER CENT CASE”. Through out the 1,000 pages it isn’t all about this topic. In the text it is debated about why and why not Grays Ferry was ever made for a interstate passageway that co-exist with the loading and unloading of businesses. The statistical numbers that was presented comes from Illinois Northern Railway and then broken down to accommodate the prime construction around Grays Ferry province... in 1914. It’s 2011 and their originally stated idea in 1914 was to integrate other major city shipment structures as a bias for the actual shippers. You can see how this community has been left out of touch with the 21st century.


Government officials have partaken in helping the community but recently none of the lobbying proposals have been put into action. It seems that the opportunity is there for the neighborhood but its all about the timing and right now in our economy, neighborhood reconstruction isn’t at the top of the To Do List for Philadelphia. I fully support The Triangles on Grays Ferry Gateway Project and hope to follow every step that the area can take on making a hidden historical landmark be discovered.

Ian McClendon Music Blog #2

​The shape of a guitar it is mainly constructed for a comfortable fit in the arms of whom is playing the instrument. Certain sized guitars can be represented for specific sizes by the length of your chest to the bottom of your palm should be the length of the guitar neck.  

-The shape of an instrument is a vital key for producing that certain sound. In the case of a acoustic guitar the structure of it should be hollow and a minimal amount of holes to reverb the vibrations of the string. Each string has a different tension and a different thickness to it which gives it the variation of sound. By strumming/ plucking a string it vibrates. Those vibrations represent the wave lengths depending on the string. Then the vibrations can be amplified by an amp for a electrice guitar or with an acoustic the hollow compression of the base allows the sound to enter the base and amplify while exiting. An example could be blowing into a empty bottle and generating that hum. 
-To change the pitch or tone of the instrument tightening the string changes that. On the top of the neck are knobs connected to each individual string. To make the tone of a string sharper it is rotated to the left. To make the tone flatter it is turned to the right. The most important part to amplify the sound is to have the string highly tensioned and a hollow base for the wave to enter and be amplified.
-I plan to use either a heavy duty card board box as my hollow base or I could construct a base with rounder edges to the waves of the sound to reverb better. As far as materials go; wood, strings, string mounts, saw, screws, drivers, other handy man necessities. I'm planning to make the guitar more of a ukulele. Higher tensioned strings with fewer frets on the neck but still retains the pitch needed for the song.

The instrument that I picked was a guitar. A string instrument with specific tensioned wires which can alter the sound that it will produce. The size, thickness, and tension is the most important components to finding the right tune. 

-The proper way to play a guitar is by plucking the string or by strumming all the strings by holding certain frets that can produce specific tones/ notes. 
- To change the note of the guitar can be done by plucking different strings and also by holding a string along the neck of the guitar. The further down the neck you hold the higher the pitch of the tone will be. Tones and notes that can flow together is counted by frets. From the top of the neck goes from 1-20 frets. Frets 3, 5, 7, 9 are the main notes to play. 
-A guitar should be shaped with horizontal length so that the strings can be placed along the neck of the guitar and pass over a hollow base where the reverb of the sound can be amplified. 
-I was thinking about how large of a hollow hole can be placed in the base and still how loud can it be? Will more holes in the guitar give it a different sound?
-As interfering waves are produced from the guitar while strumming can be more of a constructive interference and help the sound of the guitar. Also by plucking individual string along with other can correspond into a beautiful melody.

Instrument Creation - Ian McClendon

​I want to create a Harp that can have a different change of pitch with slight modifications. It could slightly resemble a guitar/ harp. The string instruments always produce of vibrant sound mixed with other instruments creates a nice melody. To play the instrument you pluck the strings that are tensioned but can also be tuned. The shape might not be like the picture but more of a box shape. I might add a symbol attached to it for more effects.

Ian McClendon - The Great Pacific Garbage Patch

What went well?
- The process of gathering the information was really useful because I was learning more about the Garbage Patch and contributing to my info-graphic. Also the art work and creative process went well. 

 

What did not? 
-The research slump. Everybody's been there before while researching something. Your brain gets stuck, you don't know what to do next, and valuable time is wasted. The only other problem was finding information that would make the poster flow. Those were only the main problems.  
 
What would you do differently next time? 
-I would gather more information, brain storm harder, think of how more creative I could be, and like everyone else, not procrastinate. 

I never really referenced the 10 Infographic Tips.

​Through weeks of art class progressively i have been learning how to shade and create still life scenes into a detailed expression with out the use of colors but the tones of dark and light. Of course, like every artist, there is needed work of the position where my light source is coming from but other wise much time and effort has been applied to show my best art.

Q3 BM Reflection - Ian McClendon

The topic that I choose was the Cold War between America and The Soviet Army during 1947-1991. I picked this because I knew that there is a lot of unsolved mysteries and missing information from that time period of history. Also because of the interesting facts that with just a little research you can feel like your discovering a mummies tomb. By writing a paper about it I felt that I could explain the Cold War thoroughly without flipping through a slide show and not being able to explain all the information needed to be said in a certain amount of time. Speaking of time, I would say when working that time was a problem to me but also getting caught in the evil research loop when you get stuck and don't know what to look for next was a reoccurring problem. But some strengths and things that I gained from this paper was actually how to conduct a seven page paper and others for improving on citing my sources in my bibliography. Also all this new information about the Cold War it's self. If I could restart this paper and reflect off of the mistakes that I made there would be quite a few changes. For one my process on completing is definitely a changing factor also where to look for most information. I was looking in the wrong places and getting data that didn't pertain to my topic. Last but not least to be way more organized. To look back and reflect I learned a lot and can do better the next time.

Recycled Paper Mache - Ian McClendon

I am a Junior at Science Leadership Academy and I was given a project to create some form of art using recycled elements. I decided that since our school uses computers every day and when we have to print papers, we make mistakes. We print to many, forgot to add parts, etc. Then what happens to all of these mistakes of paper? My idea for a art project was to collect all these mistakes and turn them into art. To even start off on a good foot I used a plastic bottle for a mold. So forth I paper mached this bottle into a creation with the mistakes. I was inspired to make a figure that I feel some what of exoticism. My main character is a alien kind of creature. I tried to represent him in a recycled form. His brother you might say. What I've learned from this project is to take consideration for what is around us and how that anything that might look just plain trash on the sidewalk can be created into some so much more beautiful and gain more of a importance.
