Reflection:


The most challenging thing I found about this project is trying to tie it in with Globalization. I chose to write my journal story about something I knew about first hand and has actually been around too see and hear on my own. I also had a hard time with trying to make the paper sound more of a blog/journal thing instead of sounding like a thesis paper.

I always knew about this story because I am from one neighborhood and has friends in the other neighborhood. I have seen these things first hand, the 17 year old boy that died was friend of mines I knew since kindergarten and the mother and son caught in the cross fire was my friend mother and brother. These things have a great effect on me, I didn't physically get shot but these things messes up people minds mentally.

I think this story doesn't receive enough attention because its always something about African Americans doing something violent in the news. Everyday you'll see inner city violence on the news so this would be just another story. But the shootings doesn't always happen in the same place in my story there's a shooting almost everyday if not everyday. The violence is senseless and  is getting out of hand. I feel like the city of Philadelphia should put more police patrol out on the streets of Philadelphia. I don't think this story will get more attention over the next few months unless another innocent person is shot dead. I learned that inner city violence is somewhat of a disease it spreads through out the youth.

World of 100 analysis

For the category religion I think I was inaccurate for all of the types of religion. I went off what I knew, my environment and how I viewed the world I live in. I know more muslims than christians so I thought more people was muslim, christian came in second place, less people are Hindu, and more people have no particular faith or other. The correct answers were that there are more christians than muslims, there's more people in the Hindu religion, less  in the Buddhist and no particular faith/other were about the same. For the language category  I was very inaccurate except for the language Chinese. I put that more people spoke english, spanish and chinese because that is what I see on an everyday basis. I was way off for other, I think because I am close minded to the other languages that are spoken across the world. Im just so used to just the U.S, Pennsylvania, Philadelphia I be forgetting that there's other people in the world.  For the geography I was almost accurate with Latina America/Caribbean, accurate with Europe and inaccurate with the rest of the categories. I thought it would be more from north america, Latin America, Asia and less for Europe, Africa. When really there's more from Asia, Africa, I put more for Latin Am., North America and Asia because that is what I mostly see in Philadelphia. Philadelphia is very diverse but I feel like those 3 are the top ones. I was really surprise by all of the categories, I felt like I failed my world of 100 people, my predictions were way off.  I was way off with my predictions because once again I went by what I knew in my environment. I am used to seeing and hearing specific so I would think they would be more popular.

Benchmark Reflection

​We  choose this topic because this is something we believe in  and it is a very controversial topic. I feel like  a lot of teenagers really dont show their view about this topic (LGBT) and I personally have experience with seeing how people treat LGBT. I like this project because we could  get creative with  the video and  we can also speaking about thing we never really pay attention to. The most interesting fact I found out was that same sex marriage was accepted in the state of California between the date of June 18th 2008 and November 5th 2008 then is was discontinued by the proposition 8. I think this project can be improved by broadening the topic and not having it relate to the constitution because you feel like you have to stay under this one umbrella and cant move out to talk about something else. It's like you wanna say more but what you want to say may not be related to the constitution. Finding out how our topic correlates with the constitution was a challenge. Finding  out a way to explain what LGBT has to do with the constitution/ the 14th amendment and then making a video about it. Also staying on track.  Working with the group I was in was a big pro in this project because we were on the same page with the video and how we were going to get our point across.  I think  I would change my process of this project and give myself enough time to figure what Im going to do, how I am going to do it and how can I make it better instead of waiting until the last minute and not turning in my best quality work because I was rushing. I learned that there was a Marriage Act that was passed in 1996 that give each a state permission to either accept or reject same sex marriage.  Only 10 states (& Washington DC) accept same sex marriage

Messerschmidt v. Miller

Messerschmidt v. Miller 


Issue:

(1) Whether police officers are entitled to qualified immunity when they obtained a facially valid warrant to search for firearms, firearm-related materials, and gang-related items in the residence of a gang member and felon who had threatened to kill his girlfriend and fired a sawed-off shotgun at her? (2) Whether United States v. Leon, 468 U.S. 897 (1984), and Malley v. Briggs, 475 U.S. 335 (1986), should be reconsidered or clarified?


Whether police officers were entitled to qualified immunity for executing a search warrant for firearms and evidence of gang activity in a home after a victim reported that the suspect had threatened her with a gun.




  November 4, 2003  Messerschmidt applied for a warrant to arrest Jerry Bowen and a warrant to search the suspect's house.  Messerschmidt made an affidavit( is a written sworn statement of fact voluntarily made by an affiant or deponent under an oath or affirmation administered by a person authorized to do so by law.) titled "statement probable cause".  The police were called to Jerry Bowen house to accompany his former spouse into the house to get her belongings so that Jerry Bowen could not harm her. After the officers on call accompanied her for about 20 minutes they had an emergency call to tend to and would return when the situation was taken care of. While the officers were gone, Jerry Bowen started assaulting his former spouse Shelly Kelly threatening her and using abusive language. Once Shelly kelly was able to break away from Jerry Bowen and make it into her car; Jerry Bowen disappeared and returned with a black sawed off shot gun. Jerry Bowen fired the gun 5 times only hitting the victim's left front tire of her car. Once Shelly Kelly got away from Jerry Bowen she approached the officers that was at her former residence and told them what happened. She told the officers that Jerry Bowen has a deadly weapon in his possession. 


From the information the officers got from Shelly Kelly they placed Jerry Bowen in a line up that contained 6 men. Shelly circled Bowen's picture without hesitation. Once Kelly identified Bowen personally the policed gathered information about him being a part of the Mona Park Crip Gang. 



"The Swat team broke into Bowen's home with the warrant & did not find him. Shortly after that, Jerry Bowen was arrested after found hiding under a bed in a motel. "But the affidavit does not set forth any evidence indicating that Bowen owned or used other firearms, that such firearms were contraband or evidence of a crime, or that such firearms were likely to be present at the Millenders' residence"

Nothing was found in the warrant or affidavit says there was probable cause to search or seize the firearms that were listed on the warrant. Probable cause did not exist. 

The officers could not prove that the affidavit was attached to the warrant.

Messerschmidt did not use the affidavit at the Millenders' residence to provide more specific direction to the investigators who searched the house

Rather, they seized Augusta Millender's shotgun, which did not resemble the firearm described by Kelly: it had a wooden stock and was neither sawed-off nor had a pistol grip.

" the deputies had probable cause to search for a single, identified weapon, whether assembled or disassembled. They had no probable cause to search for the broad class of firearms and firearm-related materials described in the warrant."

The officers tried to argue in court that Jerry Bowen was seen with this firearm, is very dangerous and is part of a gang so they had probable cause to search for other items inside his house.


The officers were  qualified for immunity.

Philadelphia Curfew Law Update

​My lobbying topic was Philadelphia Minor Curfew. Since the summer is over and school has resumed the curfew hasn't had the same publicity it had in the summer time. Beings though less kids are out during the school year at unreasonable hours the curfew law isn't pushed as hard as it was in the summer time. Just recently the curfew was just passed as a law and would not only apply to University City & Center City but throughout the entire city.Within the next 2 years the city has to prove the effectiveness of the curfew law to the City's Council. The Mayor agrees that this curfew will not stop the violence in the city but it's a good start towards it. Many of the city's residents disagree to this law says it's just a way to punish the youth.

Curfew In Philadelphia

 ​I am lobbying to change the curfew for the youth in University City and Center City, Philadelphia. In the summer of August Mayor Michael Nutter enforced a curfew on the children of Philadelphia 18 and younger. The curfew restrictions are 10:00 p.m. for those under 13 10:30 p.m. for those 13 to 17 years old Sunday through Thursday and 12:00 a.m. on Friday and Saturday. If the curfew was violated parents would be contacted and will receive a fine from $100 to $300 for first violation and will face time in custody. The curfew was enforced because of the youth of Philadelphia is out at unreasonable hours "flash mobbing". There have been several incidents where the "flash mob" has assaulted people randomly out of pure ignorance. Not only is Mayor Nutter holding the children responsible he's holding their parents saying in one interview (to parents) "it is your responsibility to know where they are, what they are doing and who they are with. They are your children. You need to raise them. You are responsible for them." Parents will be fined and can face time in jail because of what their child committed and if parents did not come pick their child up the Department of Human Services and the parent could be taken to court for other violations, including neglect of their child. Towards the end of August the curfew was strictly enforced that minors 18 and younger have to be the house by 9 pm.

 

I am lobbying against the curfew in Philadelphia because I feel as though every minor has to suffer the consequences because of what a group of kids continue to do. I am 17 teen years old and I have never been apart of a "flash mob" and there are many other teens that have not been apart of one also. I like to go downtown to restaurants, parks and concerts.  And I can no longer enjoy myself in the city of Philadelphia because I can get arrested for violating curfew. I also have a job and the curfew makes it very hard for me to transport to work.

 

I do not think that the curfew should be completely canceled but I think the older teens should not have to be restricted to certain things.

Music Instrument: Guitars

--How is it played? What does the person have to do to produce sound?
Guitars  are played buy plucking the string on the instrument with finger or a pick.
The sound of an Acoustic guitar is from the vibrations of the strings and the hollow body of it.

--How do you change a note? (you might have to watch very carefully to see this)

depending on what guitar you are playing you have to use the pick (or your fingers).
Each string on the guitar has a different note. You adjust the notes to what song your are playing.

--How is it shaped?

The body of the instrument plays a major part in the sound that comes out of it. The  body of the guitar is hollow so when you pick a string, its reaction to the hollow part of the instrument gives you a sound.

This makes me think about what type of string I would used to create the vibration and how hollow does the body of the guitar have to be.

The Phunky Peacock

I decided to draw/paint a peacock  for my art project, for the 2nd benchmark quarter. At first I was not sure what I wanted to do for my art project. I wanted to do something really colorful but simple at the same time. Less is more! I am into nature a lot like trees, animals, insects etc...

I wanted to create something no one really thought about so, a peacock came to mind. I always wanted to draw a peacock, they're really pretty and odd to me. The feathers of a peacock are beautiful, they green, the blue, the yellow just blends in together. You really don't know how pretty a peacock feathers are until they spread them out. Usually the male peacock  do that when they're mating to try to attract females.

One day I was in the art room during a free period and I starting drawing a peacock just for fun and it actually turned out to be pretty decent.  Even though it started out as something I was doing just to pass time, it came to be something really elegant and pretty. I take pride into my painting, I worked hard on drawing it the  right way, tracing lines, and trying to stay inside the lines. I contributed to my painting in and out of the classroom.

I went to my neighborhood recreation center which is Piccoli, to take pictures and to interview a person. I asked questions about the 2010 election, what they thought about it, & did they learn about it growing in school. I passed out papers with saying a voters right on it, & I drawled an art piece on the sidewalk outside of the voting center to let people know that every vote counts & getting out to vote will make a difference. I took pictures of everything then made a video that shows a student of Science Leadership Academy working outside of school, with voters to make a difference.
